In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties, and in order to ensure the protection and privacy of personal data, as well as to regulate access to, rectification, cancellation, and objection to the handling thereof (Legal basis: Article 16 of the Constitution; Articles 1 and 2 of the Federal Law on the Protection of Personal Data Held by Private Parties, and, where applicable, its Regulations).<\/em><\/p>\n\n

PRIVACY NOTICE OF \u201cGRUPO CONSTRUCCIONES VERTICALES\u201d.<\/strong><\/p>\n\n

I.- Identification of the data controller and processing of Personal Data.<\/p>\n\n

In order to comply with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, as well as its regulations (jointly, the \u201cLaw\u201d), \u201cGrupo Construcciones Verticales\u201d, its affiliated and subsidiary companies, including, by way of example but not limited to, Construcciones Verticales de Acero, S.A. de C.V., La Casa del Herrero Peninsular, S.A. de C.V., Centro de Laminados y Distribuciones del Sureste, S.A. de C.V., Industrial Constructora Metal Tec, S.A. de C.V., Montajes y Laminaciones de Acero, S.A. de C.V. (jointly, \u201cGrupo Construcciones Verticales\u201d), with address at the M\u00e9rida\u2013Tetiz highway, kilometer 21, in Tetiz, Yucat\u00e1n, ZIP Code 97364, makes this Privacy Notice (the \u201cNotice\u201d) available to you in order to establish the terms and conditions for the processing of Personal Data.<\/p>\n\n

II.- Authorization for the processing of Personal Data.<\/p>\n\n

By consenting to these terms, you, as the owner of the Personal Data, authorize \u201cGrupo Construcciones Verticales\u201d to collect, by written, electronic, telephone and\/or in-person means, as well as to process, by way of example but not limited to, the following information: name, marital status, address, telephone numbers, email address, photographs, fingerprints, copies of identification and\/or official documents, education, prior employment data, credit and\/or financial information, banking data, among others (the \u201cData\u201d), which you voluntarily provide orally, in writing, through physical, electronic, electromagnetic, visual, audio, or any other means, which may include sensitive personal data such as: ethnic origin, health status, genetic information, religious, political, moral beliefs, sexual orientation, among others (the \u201cSensitive Data\u201d and, jointly with the Data, the \u201cPersonal Data\u201d).<\/p>\n\n

Your Personal Data will be used for the purposes for which you provided it, which may include, by way of example but not limited to: recruitment and personnel selection; inclusion in our job board; inclusion in our supplier registry; customer catalog or list of prospective customers; compliance with obligations arising from civil or commercial transactions in which you are or may become a party; service agreements; financial transactions; payments or collections; or to provide you with information about our services related to our products and\/or the industry and manufacturing and assembly in general, or notices and information that may be of interest to you; as well as for statistical purposes, maintaining databases, and compliance with legal obligations arising from the employment, commercial, or any other type of relationship between you and \u201cGrupo Construcciones Verticales\u201d.<\/p>\n\n

III.- Revocation of consent.<\/p>\n\n

\u201cGrupo Construcciones Verticales\u201d has appointed a person in charge of Personal Data (the \u201cPrivacy Officer\u201d); therefore, you may revoke your consent for the processing of your personal data for certain purposes, in person before us, by means of a written request (the \u201cRequest\u201d) addressed to the Privacy Officer at the address set forth in section I of this Notice, or sent to datos@construccionesverticales.com. The Request must contain and be accompanied by: <\/p>\n\n

  1. Your name, address, and email address, so that we may communicate the response to the Request;<\/li>\n<\/ol>\n\n
      \n
    1. A copy of the documents proving your identity (copy of your official identification issued by the Federal Electoral Institute or the National Electoral Institute, passport, or any other official identification) or, where applicable, the documents proving your legal representation, the original of which you must present in order to receive the response from \u201cGrupo Construcciones Verticales\u201d;<\/li>\n\n
    2. A clear and precise description of the Personal Data in respect of which you seek to revoke consent; and<\/li>\n\n
    3. Any document, reference, or information that facilitates locating your Personal Data in our databases.<\/li>\n<\/ol>\n\n

      \u201cGrupo Construcciones Verticales\u201d will have a maximum period of 20 (twenty) business days from the date the request was received to respond and inform you of the decision adopted, so that, if applicable in accordance with the Law, the measure is implemented within the following 15 (fifteen) business days from the date the response was communicated. The aforementioned periods may be extended once for an equal period, provided that the circumstances of the case justify it. If, after revocation, you request confirmation thereof, \u201cGrupo Construcciones Verticales\u201d will respond expressly. <\/p>\n\n

      IV.- ARCO Rights.<\/p>\n\n

      You have the right to: (i) access your personal data held by \u201cGrupo Construcciones Verticales\u201d and learn the details of its processing; (ii) rectify it if it is inaccurate or incomplete; (iii) cancel it when you consider it is not required for any of the purposes set forth in this Notice, is being used for non-consented purposes, or the contractual, service and\/or employment relationship has ended; and (iv) object to its processing for specific purposes, as established in the Law (collectively, the \u201cARCO Rights\u201d). To exercise the ARCO Rights, you must submit a request (the \u201cARCO Request\u201d) to \u201cGrupo Construcciones Verticales\u201d, addressed to the Privacy Officer at the Contact Address, accompanied by the following information and documentation: <\/p>\n\n

      1. Your name, address, and email address so that we may communicate the response to the ARCO Request;<\/li>\n\n
      2. A copy of the documents proving your identity (copy of your official identification issued by the Federal Electoral Institute or the National Electoral Institute, passport, or any other official identification) or, where applicable, the documents proving your legal representation, the original of which you must present in order to receive the response from \u201cGrupo Construcciones Verticales\u201d;<\/li>\n\n
      3. A clear and precise description of the personal data in respect of which you seek to exercise any of the ARCO Rights;<\/li>\n\n
      4. Any document, reference, or information that facilitates locating your Personal Data in our databases;<\/li>\n\n
      5. If you request a rectification of your Personal Data, you must also indicate the modifications to be made and provide the documentation supporting your request; and<\/li>\n\n
      6. The ARCO Request form duly signed. To download this form, click the following link: _______.com.mx\/solicitud_arco. <\/li>\n<\/ol>\n\n

        The Privacy Officer will respond to your ARCO Request and the reasons for the decision by email within a maximum period of 20 (twenty) business days counted from the day your ARCO Request is received. If the ARCO Request is answered affirmatively or deemed applicable, the requested changes will be made within a maximum period of 15 (fifteen) business days. \u201cGrupo Construcciones Verticales\u201d may notify you, within the periods referred to in this paragraph, of a one-time extension for an equal period to the original. <\/p>\n\n

        \u201cGrupo Construcciones Verticales\u201d may deny access (the \u201cDenial\u201d) for you to exercise your ARCO Rights in the cases established in the Law, and must inform you of the reason for such decision.<\/p>\n\n

        The Denial may be partial, in which case \u201cGrupo Construcciones Verticales\u201d will carry out the access, rectification, cancellation, or objection in the applicable part.<\/p>\n\n

        The exercise of ARCO Rights will be free of charge; however, if you repeat your request within a period of less than 12 (twelve) months, the costs will be 3 (three) UMA (Unit of Measurement and Update), plus Value Added Tax, unless there are substantial modifications to the Notice that give rise to new ARCO Requests. You must cover justified shipping expenses or the cost of reproduction in copies or other formats and, where applicable, the cost of document certification. <\/p>\n\n

        V.- Transfer of Personal Data.<\/p>\n\n

        \u201cGrupo Construcciones Verticales\u201d may share Personal Data in order to comply with its legal and\/or commercial obligations, for which it has entered into or will enter into various commercial agreements. Recipients of the Personal Data are obligated, by virtue of the corresponding contract, to maintain the strictest confidentiality of the Personal Data provided by \u201cGrupo Construcciones Verticales\u201d and to observe this Notice. \u201cGrupo Construcciones Verticales\u201d may transfer your collected Personal Data to any other company within the same business group to which it belongs and that operates under the same processes and internal policies, whether located within the country or abroad, for processing for the same purposes described in this Notice. <\/p>\n\n

        Your Personal Data may be transferred, stored, and processed in a location different from where it was provided; if this occurs, the Personal Data will be transferred in accordance with the Law and other applicable provisions. \u201cGrupo Construcciones Verticales\u201d will take measures to protect your Personal Data regardless of where it is stored or to where it is transferred. \u201cGrupo Construcciones Verticales\u201d has appropriate procedures and controls in place to seek the necessary protection. If you do not express your objection to the transfer of your Personal Data, it will be understood that you have granted your consent thereto. <\/p>\n\n

        A).- Use of cookies.<\/p>\n\n

        B).- Video recordings and photographs.<\/p>\n\n

        Any person who enters the facilities of \u201cGrupo Construcciones Verticales\u201d may be recorded by security cameras and may also be photographed. The images captured by the closed-circuit television system cameras will be used for your safety, as well as the safety of the staff and other visitors of \u201cGrupo Construcciones Verticales\u201d, for the purpose of remotely monitoring production and industrial areas, offices, movable and immovable property, and confirming in real time any risk condition in order to take the necessary measures to minimize it. Likewise, photographs are intended to carry out security, access control, and identification at our facilities. <\/p>\n\n

        The video recordings and\/or photographs will be stored in our electronic files for a period of 30 (thirty) calendar days.<\/p>\n\n

        VI.- Amendment to the Notice.<\/p>\n\n

        \u201cGrupo Construcciones Verticales\u201d reserves the right to make modifications or updates to this Notice at any time in order to reflect any legislative developments, internal policy changes, or new requirements for the provision or offering of our services or products. These modifications will be available to the public through the Website. <\/p>\n\n

        By providing Personal Data physically, electronically, or by any means, you declare that you have read this Notice, understand its scope and content, and grant your express consent for the processing of your Personal Data. By not expressing opposition in writing to \u201cGrupo Construcciones Verticales\u201d, you expressly state your full agreement with the terms and authorizations contained herein.<\/p>\n\n

        VII.- Complaints regarding improper handling of Personal Data.<\/p>\n\n

        If you consider that your right to the protection of Personal Data has been violated by any conduct of our employees or by our actions or responses, or if you suspect that there is a violation of the provisions set forth in the Law in the processing of your Personal Data, you may file the corresponding complaint at the Contact Address.<\/p>\n\n
